Government cannot accord district status without prior approval: Orissa High Court

Cuttack: There is a limitation on the Government’s power to accord district status declared the Orissa High Court, said reports. The rule by the Orissa High Court further elaborated that the Government has to have the prior approval of the Court before declaring any area as a new district.

The Court further clarified that a new district cannot be declared only with a political objective in mind. The Government has to consider the financial condition of the area, the boundary and the status of the backward classes of people before declaring a new district.

This interim judgement has been passed by the Orissa High Court while hearing a matter relating to the formation of a new district in Odisha. The suit had been filed by the Rajgangpur District Action Committee.

The Court further said that the Government of Odisha can start the procedure of declaration of a new district but has to adhere to all these procedures. But, the High Court has further specifically clarified and directed that without the prior approval of the High Court, the final decision cannot be taken.

The Orissa High Court Dr. Justice Bidyut Ranjan Sarangi and Justice Murahari Sri Raman heard the case and delivered the above mentioned interim judgement.
