Bombay High Court allows bail to man booked for raping minor

The court held that the sexual relationship between the accused and the victim was out of love and not lust

Mumbai:  Bombay High Court allowed bail to a 26 year old boy recently who had been booked for raping a minor girl. The Court held that that the sexual relationship between the accused and the victim was out of love and not lust.

The Nagpur bench of the Bombay High Court granted bail to the youth in the rape case of a minor girl. The single-judge Justice Urmila Joshi-Phalke noted that though the victim girl was a minor, she left her parents’ house on her own.

Even, the minor also admitted in the police statement that she was in a “love relationship” with the 26 year old accused person.

The Court further took into account the fact that she stayed along with the accused at various places and did not raise any grievance that she was forcefully taken away.
