Lt Governor bound by the aid and advice of Delhi Govt: SC

New Delhi: In a landmark judgement, the Supreme Court on Wednesday ruled that Delhi Government has power in all areas except land, police and public order and the Lt Governor is bound by the aid and advice of the Delhi Govt in areas other than those exempted.

“The cabinet must convey all decisions to the Lieutenant Governor but his concurrence is not required in all matters,” said Chief Justice of India Dipak Misra, reading out a constitution bench judgement.

“The Lt Governor  cannot act independently unless where the Constitution allows to do so”, Misra added saying the Lt Governor  cannot be an obstructionist.

The apex court also said the Lt Governor and Delhi Ministers must settle matters by discussion and the relationship between Centre and the State Government should be healthy.

Delhi Chief Minister and Aam Aadmi Party convener Arvind Kejriwal appeared to be happy with the verdict.

The landmark decision comes days after Kejriwal and his Ministers spent nine days in a dharna at Lt Governor Anil Baijal’s house, demanding that he must step in to end an officers’ “boycott” of the AAP Government.
