A five-judge constitution bench, including Chief Justice JS Khehar, Justices Kurian Joseph, RF Nariman, UU Lalit, and Abdul Nazeer , in a 3-2 verdict, asked the government to bring a law to regulate marriage and divorce among Muslims, replacing triple talaq– the practice of Muslim men getting an instant divorce by saying “talaq” three times.
The apex court also said if the government fails to bring in law in the next six months, the court’s injunction will continue.
The constitution bench heard seven petitions filed by Muslim women challenging the 1,400-year-old practice, including one who was divorced on WhatsApp. It was argued before the court that triple talaq was a discriminatory practice and abhorrent to the tenets of the Quran.
