Odisha bring new rules in rehabilitation settlement policy, check details

General Administration & Public Grievance (GA&PG) Department of has issued a notification regarding the changes the State government med in rehabilitation settlement policy to give job to families of deceased government employees.

Bhubaneswar: After the Odisha Cabinet on Mar 21, 2025 approved the proposal to bring changes to Odisha Civil Services (Rehabilitation Assistance) Rules, 2020, the General Administration & Public Grievance (GA&PG) Department of the State government has issued a notification in this regard.

The Odisha government has brought the new rules in rehabilitation settlement policy, with the aim to give job to families of deceased government employees and with the latest decision of the government, around six hundred to seven hundred cases lying in the Supreme Court and High Court will be decided immediately, informed Law Minister Prithviraj Harichandan.

Here’s the official notification of new rules in rehabilitation settlement policy in Odisha:

In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the Governor of Odisha is pleased to make the following rules further to amend the Odisha Civil Services (Rehabilitation Assistance) Rules, 2020, namely:

  1. Short title and commencement.-

(1) These rules may be called the Odisha Civil Services (Rehabilitation Assistance) Amendment Rules, 2025.

(2) They shall come into force on the date of their publication in the Odisha Gazette.

  1. In the Odisha Civil Services (Rehabilitation Assistance) Rules, 2O2O (herein-after referred to as the “said rules’), in rule 6,-

(i) for sub-rule (9), the following sub-rule shall be substituted, namely :-

“(9) (a) All pending applications, relating to details of Government employee prior to the date of commencement of the Odisha Civil Services (Rehabilitation Assistance) Rules, 2020 shall be dealt in accordance with the rules prevailing on the date of death of Government employee for appointment under Rehabilitation Assistance Scheme:

Provided that in case the death of Government employee occurred on or after commencement of the Odisha Civil Service (Rehabilitation assistance) Amendment Rules, 20L6 and before commencement of the Odisha Civil Services (Rehabilitation Assistance)Rules, 2020, shall be governed by the provisions of the Odisha Civil Service (Rehabilitation Assistance)Rules, 1990.

(b) In case the death of Government employee occurred prior to commencement of the Odisha Civil Service (Rehabilitation Assistance) Amendment Rules, 20!6, shall be dealt on the basis of distress certificate available in the existing or’ original application as per the Odisha Civil Service (Rehabilitation Assistance) Rules, 1990.

(c) In case the death of Government employee occurred on or after commencement of the Odisha Civil Service (Rehabilitation Assistance) Amendment Rules, 2OLO and before commencement of the Odisha Civil Services (Rehabilitation Assistance) Rules, 2020, the appointing authority shall ascertain the present financial distress of the family by calling for a report from Collector of the district in which the family ordinarily resides, as to whether [he n’.’ family is in financial distress as per the provisions of rule 8 of the Odisha civil Service (Rehabilitation Assistance) Rules, 1990.

Explanation for the distress certificate prescribed under clause (c).- The total annual family income from all sources excluding Family pension and temporary increase must not exceed Rs.1,g1,000/- (Rupees One Lakh and Ninety-One Thousand) for a family to be in ‘distress condition’.”.

(ii) the sub-rule (10) shalt be omitted

  1. In the said rules, for rule 9, the following rule shall be substituted, namely.-

“9. Seniority: (1) Seniority of persons, appointed under the Rehabilitation Assistance Scheme, shall be fixed below the persons appointed to the posts as per the provisions of the relevant recruitment rules in a particular Department or Office in that year.

(2) The relative seniority of each person appointed under the Rehabilitation Assistance Scheme in a particular year shall be determined with reference to their date of appointment:

Provided that in case their date of appointment is same, the date of death of the Government servant shall be the factor for determination of relative seniority:

Provided further that in case the date of death of the Government servant is also same, the persons older in age shall be placed higher.”
