Bhopal: A 52-Year-Old Woman has been granted permission for In Vitro Fertilisation (IVF) by High Court in Madhya Pradesh after hospital refused to do it. It says age is not the boundary to decide if a woman can become mother or not.
This comes following the 52-Year-Old Woman and her husband approached the court after denial of IVF for them at a private hospital.
The hospital refusal was because of the Assisted Reproductive Technology (Regulation) Act, 2021 that states that woman with age between 21 and 50 years can only undergo In Vitro Fertilisation (IVF).
However, the age was only the restriction as she was medically fit to carry and give birth to a baby with that procedure.
The High Court has ruled that a couple may undergo IVF at any recognized medical institution. The court stated that while hospitals can conduct medical tests to ensure safety, they cannot deny the woman’s application solely on the ground that she is 52 years old.
The couple lost their only 21-year-old son in 2025 to organ failure and jaundice. They approached the court seeking permission for IVF to have another child. Citing their exceptional circumstances, the court granted them relief.
