New Delhi: In a major relief for Congress MLA Jogesh Kumar Singh, the Supreme Court on Tuesday issued a stay order on Orissa High Court’s decision to disqualify his candidature. This was informed by senior Advocate Pitambar Acharya.

In its hearing in the case, the Apex Court said that Singh will continue as member of Odisha Legislative Assembly.

Expressing his happiness over the SC verdict, Jogesh Singh, said “I had complete faith on the Judiciary for which I had moved the honourable Supreme Court and finally the truth prevailed. I thank the people of Sundergarh for their support and love.”

The Orissa High Court had on January 30 declared the Sundergarh legislator’s candidature null and void. The court had said that Singh had submitted fake caste certificate while filing his nomination for the 2014 Assembly Elections.

BJP candidate Sahadev Xaxa, who lost to Singh in the 2014 Assembly Elections, and another voter Ajay Patel had alleged that the MLA submitted false and fabricated caste certificate categorising himself as ‘Bhuyan’ tribe.

While conducting the hearing, the court had found out that the Congress MLA belongs to ‘Khandayat Bhuyan’ community which is not a Scheduled Tribe.
